  1. General
    Nebojsa Pavlovic (founder of Mind-Craft) carries out the coaching and physical activities in accordance with these Terms and Conditions. This way of working is based on the definitions and contents of the Mind-Craft theory, which are recorded on this website.
    The subject of the coaching is the provision of the agreed service according to the grind plan recorded in the analysis phase. This is done based on the information, statements, needs, intentions, and fitness results of the client. No activities are carried out with which the customer does not agree. There is no guarantee that a certain success will be achieved. The number of sessions can vary depending on the topic, course and success and is to be determined by the customer. Before each session, there is a short conversation about the well-being and the grind process.
    By commissioning the coaching, these terms and conditions shall be deemed to have been accepted by the client.
    Mind-Craft does not make a promise to achieve the customer’s goals, as this is related to the customer’s individual effort. The customer agrees to actively participate in his/her progress. See more under “12. Mind-Craft Game Rules”.
  2. Offer / Fee
    According to the agreement, the fee is charged in Swiss francs and is usually due at the end of a session. Exceptions can be made by arrangement. The exact prices will be stated in the offers before the sessions and must be confirmed in writing (e-mail, letter, text message) by the customer.
  3. Terms of Payment
    Missed or canceled appointments too late (less than 48 hours in advance) will be charged at 100%.
    Invoices and receipts are issued via e-mail (electronically). The deadline for payment of the invoice is 30 days from the date of the invoice. The receipts after receipt of payment are also issued electronically. Possible payment methods are invoices or Twint bank transfer.
  4. Validity of Offers
    Offers must be confirmed electronically/in writing by the customer at least 48 hours before the agreed date. If an appointment is confirmed in time, the offer becomes legally binding. If the offer is not confirmed 48 hours before the agreed date, Mind-Craft reserves the right to cancel the appointment in writing. With the written/electronic confirmation of the offer, the customer declares that he/she is willing to carry out the defined jointly defined activities. If the customer does not agree with individual activities of the offer, the entire offer will be null and void and revised.
  5. Appointments
    Agreed dates are generally binding. The time and place of the coaching will be mutually agreed between Mind-Craft and the client. In the offer and in the grind plan, the time and place are recorded in writing. The customer undertakes to attend all meetings, as far as possible, in accordance with the agreement. A free cancellation or postponement of the sessions is possible at least 48 hours before the appointment. In the event of no-show or late cancellation, 100% of the amount according to the confirmed offer will be charged as a cancellation fee.
    As a result of illness, accident or emergency, the customer can postpone the agreed appointment at any time. In this case, we will inform each other promptly and agree on an alternative date.
    If the client wishes to interrupt the ongoing process or stop working together during the session, this will be done by arrangement. The services rendered by the coach up to this point in time are to be remunerated immediately, if they have not already been provided.
    If the arrival is too late, the activity is shortened.
  6. Data Protection
    All documents prepared with the customer and handed over to him/her are included in the agreed service. The documents are intended for the personal use of the client. The copyright to the grind plans and other documents handed over by Mind-Craft belongs solely to Mind-Craft or Nebojsa Pavlovic. The client is not permitted to reproduce any documents of Mind-Craft, in whole or in part, and/or to make them accessible to third parties without the written consent of Nebojsa Pavlovic (rights of Mind-Craft).
    Nebojsa Pavlovic undertakes to carefully store the documents created and provided for the purpose of coaching and to protect them against inspection by third parties.
    Mind-Craft stores customer details on the customer-specific index card in electronic form. All Mind-Craft employees have access to it. It will not be passed on to third parties for advertising purposes. Furthermore, data will be used for the purpose of making an appointment to provide information about our range of services, if desired (to be declared in the online contact form). In principle, the customer has the right to information, correction, deletion, restriction, data portability, revocation, and objection.
  7. Prerequisite/personal Responsibility of the Client
    Participation in grinding (coaching) requires normal mental and physical resilience. The client bears full responsibility for himself or herself and his or her actions inside and outside the sessions. The sessions are not psychotherapy or other therapy and cannot replace it. Due to the intensive training, Mind-Craft employees may have to give physical support to the customer and get physically close. It is emphasized that it is pure support to create the maximum potential of the customers and to exceed their own limits. Mind-Craft distances itself from any form of sexual harassment.
  8. Liability and Risks
    A general success of the sessions is not owed. Whether the grinding shows success and how quickly the progress is noticeable correlates strongly with the individual behavior and mental attitude of the customer. The definition of physical activities is made by mutual agreement between Mind-Craft and the customer. Mind-Craft assumes no liability for risks, injuries, accidents, or illnesses suffered during the performance of the activities and the analysis (fitness-test). Since the physical activities are demanding and the training sessions are intense, depending on the condition of the client’s physique, the following side effects may occur during or after the activities: Fatigue, Stiffness, Headache, Dizziness, nausea, etc.
    According to the theory of Mind-Craft, one has on the way to achieving one’s goals, overcoming hurdles, suffering, sacrificing things and dedicating oneself absolutely to progress. This path requires breaking out of the comfort zone. In this case, Mind-Craft intends to motivate its customers not to give up, to deal with the pain (e.g., burning of the muscles), and pushing beyond these limits.
  9. Confidentiality
    At the beginning of the analysis, personal information of the client is collected (goals, intentions, own strengths, and weaknesses, etc.), which also includes questions about the state of health (e.g., taking medication, complaints, etc.). Mind-Craft undertakes to maintain secrecy vis-à-vis third parties about all private and business matters of the client and other caregivers that have become known during the activity during and after the end of the coaching.
  10. Participation of the Client / Success of the Coaching / Procedure
    The Mind-Crafting process is based on cooperation and mutual trust. It is a free, active, and self-responsible process. Mind-Craft supports the customer in grinding and personal progress. Mind-Craft is assisting, motivating, and pushing customers beyond their own limits. Together, it ensures that maximum potential is being reached. The actual progress is made by the client. The customer should therefore be willing to reflect on himself/herself, to benefit from the grinds in the best possible way.
    The result of a coaching session is aimed at the individual development of the customer.
    Before the analysis, the entire mind-craft process is described, and the procedure is explicitly explained. In the grind plan all details of the individual activities are recorded.
  11. Differentiation from other forms of therapy / psychotherapy
    Mind-Craft coaching is not a therapy and does not replace it. Coaching is based on a coach-client relationship, which is characterized by a partnership and clearly distinguishes the role of the coach from therapists, doctors, psychologists, or any sect.
    Mind-crafting is based on progress through the practice of hard, demanding physical activities. The basis defines the customer’s goal that he or she wants to achieve with the grinding (e.g., Self-discipline, breaking out of the daily comfort zone, etc.). Mind-Craft serves people who are ready for positive change, for strengthening their mental power and who are striving for the best version of themselves.
  12. Mind-Craft’s Rules of the Game
    1. I never lose my focus on my goals and personal development.
    2. My intentions are generally related to mental development and are not aimed at strengthening physical aspects/physicality.
    3. During the grinds, I try to reach my maximum potential and to go beyond my limits.
    4. During the grinds, I carry out the promised activities and do not deviate from the plan, breaks and rest if necessary are part of the activities.
    5. During the grinds, telephones, no matter for what purpose (communication, photos/videos, social media, etc.), can only be used with the consent of the coach.
    6. I study and internalize the theory of the Mind-Crafting process, in case of ambiguity I turn to Mind-Craft.
    7. I distance myself from comparisons and measurements with third parties, I just want to be better than myself.
    8. In the presence of Mind-Craft employees, racist, discriminatory, or sexual statements as well as activities are taboo for me. I accept that in repeated cases these will lead to the immediate termination of the session.
    9. I keep the agreed appointments or cancel in good time: 48 hours in advance.
    10. I acknowledge that I will be charged 100% for missed appointments or those canceled too late.
    11. I accept that I will confirm or reject the offers received in writing/electronically at least 48 hours before the agreed date.
  13. Place of performance and jurisdiction
    The place of performance and jurisdiction is Killwangen/AG (Switzerland). Swiss law applies.
