1. Scope
These General Terms and Conditions apply to all contracts between Mind-Craft

Owner: Nebojsa Pavlovic

Email: info@mind-craft.ch
Phone: +41 79 944 21 47

hereinafter referred to as "Mind-Craft", and its clients.

These Terms and Conditions apply in particular to individual coaching, mental training, consulting, workshops, resilience training, activities and individually agreed training programs. Deviating agreements require written or electronic confirmation by Mind-Craft.

2. Offer and conclusion of contract
The presentation of services on the website does not constitute a legally binding offer. A contract is concluded as soon as an appointment, a coaching package or another service has been confirmed by Mind-Craft in writing, electronically or verbally.
By making a booking, the client confirms that they have read and accepted these Terms and Conditions.
The type, scope, location, duration and goals of the collaboration are agreed individually. The respective booking confirmation, quote or a separate coaching agreement is authoritative.

3. Subject matter of the services
Mind-Craft offers mental coaching in the areas of self-organization, mental techniques for self-regulation and resilience training.
The services may include, in particular, the following elements:

  • Goal clarification and goal planning, goal-setting techniques

  • Mental training (breathing, visualization and self-talk techniques, mindfulness exercises, autogenic training, progressive muscle relaxation)

  • Increasing mental strength through active resilience and resistance training

  • Promoting self-organization skills and everyday structure

  • Developing positive habits and routines, tackling harmful behavior patterns

  • Building and applying reflection and self-observation methods

  • Regular progress reviews and check-ups (online and/or in person)

  • General consulting services on personal development, mental training, building resilience, self-organization and goal setting

The specific scope of services is based on the individual agreement.

4. Distinction from medical and therapeutic services
Mental coaching does not replace medical, psychological, psychotherapeutic, psychiatric or physiotherapeutic examination, diagnosis or treatment.

Mind-Craft does not guarantee healing or success and does not treat mental or physical illnesses. In the event of relevant symptoms or doubts, clients are obliged to consult a suitable medical or therapeutic professional.

Mind-Craft may decline, interrupt or end a coaching engagement if health-related or psychological reasons stand in the way of carrying it out safely. In acute crises or emergencies, a medical emergency service or another appropriate professional body must be contacted immediately.

5. Participation and personal responsibility
Mental coaching is an active process based on personal responsibility. Clients decide for themselves to what extent they implement recommendations, exercises and agreed measures.

No specific personal, professional, athletic or health-related success is owed. The success of the collaboration depends largely on active participation, the client's personal starting point and consistent implementation outside the coaching sessions.
Clients undertake to provide Mind-Craft with all information relevant to safe and appropriate delivery of the services.

6. Health requirements
Physically or mentally demanding activities require appropriate fitness and health. Clients are obliged to inform Mind-Craft before starting of any health restrictions, injuries, illnesses, pregnancies, ongoing treatments or the use of relevant medication.

In case of uncertainty, a medical assessment must be obtained before participating. Mind-Craft may require a medical certificate or written clearance to participate for individual activities.

Clients undertake to report any stress limits, pain, dizziness, breathing difficulties or other symptoms immediately and to stop an exercise if necessary.

7. Resilience training
Wherever possible, the activities used in resilience training are adapted to the client's personal starting point, fitness level, experience and agreed goals.

Before an activity is carried out, its content, intensity, conditions and identifiable risks are discussed. Participation is voluntary. A client may decline or stop an exercise at any time.

Instructions from Mind-Craft, in particular safety, equipment and conduct instructions, must be followed. Unauthorized deviations, taking additional risks or participating under the influence of alcohol, drugs or medication are not permitted.
More demanding activities may be made conditional on the successful completion of preparatory sessions and on an additional health assessment.

8. Insurance
Taking out adequate health, accident, liability and, where applicable, travel or supplementary insurance is the responsibility of the client.

Mind-Craft does not provide insurance benefits and does not cover any costs that are not covered by insurance.

9. Appointments and delivery
Appointments take place at the agreed location, online or outdoors. For outdoor activities, weather, terrain and other external conditions must be taken into account.

Mind-Craft may adapt, postpone or cancel an activity for safety reasons. This applies in particular in the event of unsuitable weather conditions, health concerns or unforeseeable hazards.

If Mind-Craft postpones an appointment, a replacement date will be offered wherever possible. Further claims exist only within the scope of mandatory statutory provisions.

10. Prices and terms of payment
The prices agreed at the time of booking apply and are stated in Swiss francs. Unless otherwise stated, prices are exclusive of statutory VAT.

Additional costs, for example for travel, accommodation, meals, admission fees, materials or external providers, are agreed in advance or shown separately.

Invoices are payable within 30 days of the invoice date without deduction. Mind-Craft may request advance payment.
In the event of late payment, Mind-Craft may suspend further services until full payment has been received and charge the statutory default interest as well as necessary reminder and collection costs.

11. Cancellations and rescheduling
Individual appointments can be rescheduled or cancelled free of charge up to 24 hours before the appointment.
For later cancellations or no-shows, the agreed price may be charged in full. In the event of illness, accident or other unforeseeable serious events, Mind-Craft may, at its own discretion, offer a replacement appointment or waive the cancellation fee in whole or in part.

Late arrival by the client generally shortens the agreed coaching time. This does not entitle the client to an extension or a price reduction.

Different cancellation terms may be agreed for multi-day training courses, workshops and events. These will be communicated before booking.

12. Coaching packages
Where coaching packages are offered, they must be used within 12 months of the first appointment, unless otherwise agreed.

Appointments not taken expire at the end of the agreed validity period, unless mandatory statutory provisions dictate otherwise.

If a client ends a package early, services already received, costs incurred and cancellation fees owed will be taken into account. Any remaining credit will be refunded, unless a different, legally permissible agreement has been made.
The right of both parties to terminate a contract in accordance with mandatory statutory provisions remains reserved.

13. Cancellation or termination by Mind-Craft
Mind-Craft may cancel or postpone appointments or end the collaboration for good cause. This includes, in particular, illness, force majeure, safety concerns, lack of cooperation, repeated late payments or behavior that makes a relationship of trust unreasonable.

Services that have already been paid for but not yet provided will be refunded, unless they can be offset against justified counterclaims.

14. Liability
Mind-Craft provides the agreed services with due care and to the best of its knowledge.

Liability is governed by the statutory provisions. To the extent permitted by law, liability for slight negligence is excluded. Liability for damage caused intentionally or through gross negligence is not excluded.

Mind-Craft is not liable for damage attributable in particular to the fact that a client:

  • withheld relevant health information,

  • failed to follow safety or conduct instructions,

  • modified exercises on their own initiative or performed them beyond the agreed extent or with gross negligence,

  • disregarded personal stress limits, or

  • took part under the influence of alcohol, drugs or impairing medication.

To the extent permitted by law, Mind-Craft is not liable for the conduct of independent third-party providers. No liability is accepted for clients' personal belongings.

Participation in physical, sporting or otherwise demanding activities is generally at the client's own risk.

Despite careful planning, instruction and delivery, exhaustion, discomfort, injuries, health impairments or accidents cannot be completely ruled out.

By concluding the contract, the client confirms that they have taken note of and accepted the risks associated with the agreed activities and the provisions on health, insurance and liability set out in these Terms and Conditions.

15. Confidentiality
Mind-Craft treats personal information received in the course of coaching as confidential.
Information is only passed on to third parties with the client's consent, on the basis of a legal obligation, or where this is necessary to avert a serious and imminent danger and is legally permissible.

Confidentiality continues to apply after the collaboration has ended.

16. Data protection
Mind-Craft processes personal data in accordance with applicable Swiss data protection law. Details on the processing, storage and disclosure of personal data are set out in the separate privacy policy.

Health data and similar information may constitute sensitive personal data. Such information is only processed insofar as this is necessary for the safe and agreed provision of services, or where corresponding consent or another legal basis exists.

The privacy policy is available at Privacy Policy.

17. Electronic communication
Communication between Mind-Craft and its clients may take place by email, phone, video conferencing systems, messaging services or other electronic means of communication. Training plans, coaching materials, appointment confirmations, invoices and other documents may be sent electronically.

Clients acknowledge that, despite appropriate security measures, risks relating to confidentiality, data loss or unauthorized access by third parties cannot be completely ruled out with electronic communication.
By using electronic means of communication, clients consent to this form of communication.

18. Copyright and rights of use
Documents, training plans, concepts, texts, videos and other content provided by Mind-Craft are protected by copyright.
They may be used exclusively for personal purposes. Reproduction, publication, distribution, modification or commercial use is not permitted without the prior consent of Mind-Craft.

19. Photo, video and audio recordings
Photo, video or audio recordings of clients are only made and used with prior consent.
Consent for marketing or publication purposes is voluntary and can be withdrawn with effect for the future. Participation in coaching does not depend on such consent.

Clients' own recordings during coaching or training may only be made and published with the consent of all identifiable or audible persons.

20. Changes to the Terms and Conditions
Mind-Craft may amend these Terms and Conditions for future contracts. For a contract that has already been concluded, the version accepted at the time the contract was concluded generally applies.

Material changes to ongoing contractual relationships will be communicated in good time. Clients' mandatory rights remain reserved.

21. Severability
Should any provision of these Terms and Conditions be wholly or partially invalid or unenforceable, the remaining provisions shall remain unaffected.

The invalid provision shall be replaced by the applicable statutory provision.

22. Applicable law and place of jurisdiction
Swiss law applies.

To the extent permitted by law, the place of jurisdiction is Killwangen, Canton of Aargau. Mandatory statutory places of jurisdiction, in particular in favor of consumers, remain reserved.
